Tackling the Challenges of the New Labor and Social Dialogue Laws in Romania
Solidar Swiss, in collaboration with its Romanian partners, CONECT, CNS Cartel ALFA and CNSLR-FRATIA, will carry on, starting with 2014, a three-year project aiming to reestablish the confidence in collective actions and in the values of social dialogue. The project is part of the Swiss-Romanian Cooperation Programme and it is co-financed by a grant from Switzerland through the Swiss Contribution to the enlarged European Union.
Until 2017, the Romanian social partners - Romanian Trade Unions, Employers and Civil Society Organization, Labor Inspection, Ministry of Labor Swiss Employers, Trade Unions, national and local administration – will be supported by good practices from Switzerland, recommendations based on evidence from extensive research, and consultation with trade unions members, through regional seminars and consultations, thus contributing to the improvement of the dialogue between the social partners and the Romanian Government in the field.
The project aims to contribute to an enhanced commitment by social partners and government to build a stable climate enabling employers and trade union organizations to effectively engage in the promotion of decent work and the respect for the fundamental rights of freedom of association and collective bargaining. The implementation of the current proposal should have two major outcomes:
- Promote the use of evidence-based advocacy tools in the development of solutions to broaden and enhance legislative/policy making capacity for effective social dialogue, the promotion of decent work, fundamental rights of freedom of association and collective bargaining.
- Boost the organizational capacity of the union movement from 8 regions in Romania, based on the Swiss capacity building good practices.
The project comes with a set of activities aimed at strengthening industrial relations in Romania and restoring the viability of the concept and practice of social dialogue. The added value of the project is given by the results of these activities, most innovative for the labor market in Romania:
1. www.relatii-industriale.ro, an online platform - a unique platform of information on decent work, social dialogue, the current state of collective bargaining and dispute resolution/settlement; the novelty will be that this platform will centralize all existing information about above mentioned topics and promote the concept of "industrial relations" beyond the sphere of interest of trade unions and employers' associations. The editorial policy of the site will be decided by an editorial board.The most important actors in industrial relations and representatives of foundations and research institutes will be part of.
2. Legal and sociological research will be part of a series of evidence-based advocacy tools and proposes an ex-post evaluation of the new labor legislation and social dialogue, used from 2011 to present. So far, there is no thorough study or scientific research, to analyze the impact of new legislation on labor relations and industrial relations in Romania.
3. The catalogue of atypical employment will identify and refine new forms of employment practiced in Romania and Switzerland. This catalog will support the promotion of decent work and quality jobs, and the role of labor law in tackling these situations based on practice in both countries, and helps to prevent all forms of cheating and ill-treatment in the labor market.
4. The exchange of experience between labor inspection offices and social partners in Romania and Switzerland will allow the promotion of voluntary standards and certifications, which can complement the efforts of public institutions to improve working conditions, health and safety at work, using various models of Switzerland.
5. The program of visits by Swiss-Romanian joint union teams in 3 factories in Switzerland and their subsidiaries in Romania will help to develop capacity for dialogue of social partners, by providing information on the processes of unionization, collective bargaining and dispute resolution in the two countries.
6. The Help Kit will support workers in the process of establishing a union and will contribute to strengthening the capacity of workers to organize and participate in social dialogue.
7. Campaign awareness regarding/on the importance of social dialogue will run in the last year of the project and will focus on promoting fundamental principles and rights at work and social dialogue, in order to raise awareness about rights and obligations, constructive dialogue and negotiations, to revive public debate on these issues and to raise public awareness about the need for effective industrial relations, decent work and quality jobs, based on best practices in this field Swiss.
8. White Paper. Policy paper on labor legislation and social dialogue - is an agreeing policy document developed as a tool to be used by the social partners in their efforts to improve the legislation. It is one of the fundamental actions during the 3 years of transformation and consolidation of industrial relations.
9. Final Conference will reflect the state of industrial relations in Romania in early autumn of 2017 at the end of three years of transformations and changes in social and political-legal in Romania, and will increase awareness of stakeholders about the new instruments that the social partners use to improve industrial relations, based on best practices in this field Swiss.
This project comes as a normal continuation of over a decade of cooperation between the project partners in working together to improve and modernize labor market, trade union activity and social dialogue.
The project target group are social partners and employees, prospective employees or those looking for a job and migrants – i.e. potential union members. Besides these professionals, public institutions involved in tripartite social dialogue committees (sectoral ministerial and regional) and NGOs (as part of the Economic and Social Council) are also part of the target audience of the project.
